Wilcox County Alabama October 9th 1840

Know all men by these presents that I William Gaston of the State and County aforesaid in a sound state of mind and perfectly compos mentis at the time of making and signing of this my last will and testament. Therefore know all men by these presents that after paying all my just debts I give and grant two hundred dollars to be appropriated to the building of a Cumberland Presbyterian meeting house also a piece of land surveyed for that purpose near the South east corner of Thomas Trammel's land and north east corner of G.D. Spiva's. I also wish a sufficient sum of money dedicated from the estate to board and educate my two sons James Hugh & John Newton. I wish my daughter Sarah Emeline to have one half of my household furniture also one half of my beds and bedding the remaining half of each to my two [] sons after these deductions. I wish my estate equally divided amongst my three children. I wish my daughter Sarah Emeline's portion of land to be surveyed to as to include my dwelling house and all other necessary buildings on the premises and a sufficiency of cleared land. I also give and bequeath unto her a yellow girl named Caroline also a negro girl named Eliza and the balance of her negroes to be taken from that stock of negroes given to her mother from her father's estate according to her own choice. I desire my property should be kept together if the executor can find a man or show he thinks he can place confidence as an overseer if Emeline should marry a man whom he should deem capable to manage the farm. I would prefer him ifit is thought this cannot be done he may at anytime sell them if they can find master to suit themselves otherwise hire them privately if he can if not publicly, if the executor thinks the property cannot be profitably kept together. I wish all the balance of my perishable property to be sold privately if an opportunity offers if not publicly also my land not considered profitable to the estate to be disposed of by the execuutor where an opportunity presents itself. I desire my daughter Sarah Emeline to take the charge of raising and educating my two sons or her husband if she should marry and I do hereby appoint David Boyd the executor of this my last will and testament. Personally appeared in open court Ebenezer Gaston one of the witnesses to the last will and testament of Wiliam Gaston decd who having been duly sworn deposes that he saw the said William Gaston sign seal publish & declare the same as his last will and testament on the day abd date therein mentioned and that he believes the testator to have been of sound and deposing mind and memory at the time of executing the same and also that he together with Wiliam Floyd & Hugh G. Weir the other subscribing witnesses thereto signed the same as witnesses in presence of each other & of the testator.
